The railroad owns the land. The trains ALWAYS have the right of way. I hate what happened to these people, but no matter if there are signs gates at crossings its responsibility falls on the drivers to make sure its ok.
Stop, look both ways, if clear-cross!! Simple
Ignorance is the root cause!
Take out all railroad driveway crossings. The railroad was there first.
